Gamdo Terms of Service

These Terms of Service (the “Terms”) govern your use of Gamdo (the “Service”), available at https://gamdo.my. The Service is operated by EarthMera (“we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

These Terms apply only to Gamdo. Other EarthMera products are governed by their own terms.

1. The Service

Gamdo is an AI-powered card news generator and publishing tool. The Service generates branded card news content based on topics and brand details you provide and, upon your explicit per-post approval, publishes the content to social media accounts that you own and have connected to the Service (currently Instagram and TikTok). The Service also includes tools for managing comments on posts you published: a comment reply workbench and an optional keyword-based direct message auto-reply feature (see Section 4).

2. Eligibility and Accounts

  • You must be at least 13 years old to use the Service.
  • All registration information you submit must be true, accurate, and current, and you must keep it up to date.
  • You are responsible for keeping your password confidential and for all activity that occurs under your account.
  • You may not access the Service through automated means or use it for any illegal or unauthorized purpose.

3. Connected Social Media Accounts

3.1 Instagram

  • You may connect your own Instagram account to the Service via the official Instagram OAuth flow. To use Instagram publishing features, you must own an Instagram Business or Creator account.
  • Upon connection, you grant the Service only the following four permissions:
    • instagram_business_basic: read basic account info (username and account type) solely to show the connected account in the UI and confirm that publishing occurs only to that connected Instagram professional account.
    • instagram_business_content_publish: publish card news content, individually approved by you, to your own Instagram feed.
    • instagram_business_manage_comments: read comments on posts you published and post the replies you write or approve, solely to power the comment reply workbench.
    • instagram_business_manage_messages: send direct message replies according to automation rules you create (see Section 4).
  • The Service does not request, use, or store any Instagram permissions beyond the four listed above, and cannot access insights, advertising features, or any Instagram account other than the ones you connect yourself.

3.2 TikTok

  • You may connect your own TikTok account to the Service via the official TikTok OAuth flow (TikTok Login Kit).
  • Upon connection, you grant the Service permission to read your basic TikTok profile information (display name, avatar, and account identifier), used solely to show the connected account in the UI, and permission to publish content to your own TikTok account through TikTok’s official Content Posting API.
  • The Service does not request, use, or store any other TikTok permissions or data, including your videos, comments, direct messages, or follower information.

3.3 Scope and Disconnection

  • The Service publishes only to social media accounts you have connected yourself. The Service cannot access, modify, or publish to any other account.
  • You may disconnect a connected account at any time from the Service’s settings page. Upon disconnection, the Service promptly revokes and deletes the stored OAuth token from its database.

4. User-Initiated Publishing and Automated Replies

4.1 Publishing

  • Each post, including any scheduled post, must be individually created, reviewed, and expressly approved by you before it is queued.
  • The Service does not perform recurring, bulk, or rule-based posting to your feed, and does not publish any content without your prior approval of that specific post.
  • Scheduled posts are executed using the stored token only for the specific post you previously approved, at the time you selected. You may cancel a scheduled post at any time before its scheduled publication.

4.2 Automated direct message replies (auto-DM)

  • Separately from publishing, you may optionally create automation rules that send a direct message you pre-wrote when a comment on your own post matches keywords you configured. This is a rule-based messaging feature: it operates only under rules you create, and only on your own connected account.
  • Incoming comment and message events are processed in real time to match your rules and are not stored by the Service. The Service never sends a message you did not write.
  • You may edit, pause, or delete an automation rule at any time from the Service. You are responsible for ensuring your automated messages comply with the applicable platform rules.

5. AI-Generated Content

  • Card news text and images are generated by third-party AI providers (OpenAI and Google Gemini) based on your topic and brand inputs.
  • The comment reply workbench can draft a suggested reply with AI. When you request a draft, the text of the comment being replied to is sent to OpenAI (never to Gemini), without the commenter’s identity. Drafts are shown to you for review and are sent only when you choose to send them; drafts you do not send are not stored.
  • AI-generated content is presented to you as a draft. Before any publishing, you must review the draft, optionally edit the text, images, layout, and order of slides, and explicitly approve the final content. No content is published without this review and approval step.
  • You are solely responsible for ensuring that published content complies with the applicable platform rules (including the Instagram Community Guidelines and the TikTok Community Guidelines) and applicable laws.

6. Your Content

You retain ownership of the content you create with the Service, including topics, brand materials, edited text, and the resulting card news. You grant us a limited, non-exclusive license to host, store, process, render, and transmit that content solely to operate and provide the Service, including publishing it to the social media accounts you designate. You represent that you have the rights necessary to the materials you provide and that your content does not infringe the rights of any third party.

7. Acceptable Use

As a user of the Service, you agree not to:

  • use the Service in violation of any applicable law or regulation;
  • create or publish content that is unlawful, deceptive, infringing, harassing, hateful, or that violates the rules of the platform it is published to;
  • circumvent, disable, or interfere with security-related features of the Service, or attempt to gain unauthorized access to accounts, systems, or data;
  • use scripts, bots, scrapers, or other automated means to access the Service, or interfere with or place undue burden on the Service;
  • impersonate another person or misrepresent your affiliation with any entity;
  • reverse engineer, decompile, or copy the Service’s software except as permitted by applicable law; or
  • resell or transfer your account or use the Service to compete with us.

Violation of this section may result in suspension or termination of your account.

8. Intellectual Property

The Service itself, including its software, design, text, graphics, and trademarks, is owned by or licensed to EarthMera and is protected by intellectual property laws. Except for the rights to your own content described in Section 6, no rights in the Service are granted to you other than the limited right to use it in accordance with these Terms.

9. Fees

The Service is currently provided free of charge. If we introduce paid features in the future, we will provide notice and updated terms, and no charge will apply without your consent.

10. Termination and Account Deletion

  • You may request deletion of your Gamdo account at any time from the Service’s settings page. Account deletion is processed after a 72-hour grace period, during which you may cancel the request by signing in and choosing to cancel deletion. After the grace period expires, the Service deletes all associated user data, including social media integrations, stored tokens, generated card news content, and scheduled posts.
  • If you cannot access your account, you may also request deletion by emailing support@earthmera.com. For step-by-step procedures, see the Data Deletion page.
  • We may suspend or terminate your access to the Service if you materially breach these Terms, if required by law, or to protect the Service and its users. Where reasonable, we will notify you of the reason.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

13. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party arising out of your content, your use of the Service, your breach of these Terms, or your violation of the rights of a third party.

14. Changes to the Service or These Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time. The updated version will be indicated by the “Last updated” date at the top of this page, and material changes will be notified through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. Nothing in this section deprives you of mandatory consumer protections under the laws of the country or state in which you reside.
